How overtime and hours work

Under the CCNT / L-GAV, the standard contractual week is 42 hours (43.5 for seasonal operations, 45 for small businesses). Hours worked beyond the contractual week count as overtime, paid at a flat 25 percent premium or compensated one-for-one with time off. Switzerland's Labour Act sets an absolute ceiling of 50 hours per week for the sector, averaged over any 12-week period. A working day may not exceed 11 hours of work within a 14-hour span, and employees are entitled to at least 11 consecutive hours of daily rest and 35 hours of weekly rest.

What is the normal working week and when does overtime begin?+

The standard contractual week is 42 hours (43.5 seasonal, 45 for small businesses). Any hours worked beyond the applicable contractual week are treated as overtime, compensated either with a 25 percent pay premium or, by agreement, with equivalent time off at a 1:1 ratio.

How much overtime can be worked before the legal ceiling?+

The absolute maximum is 50 hours per week, also as the 12-week average. So beyond the 42-hour contractual week you have headroom up to the 50-hour Labour Act ceiling. Hours above 50 per week always require the 25 percent premium and cannot be simply averaged away.

What rest periods must employers respect?+

Employees must receive at least 11 consecutive hours of daily rest and at least 35 hours of weekly rest. Daily work is capped at 11 hours, which must fit within a maximum 14-hour span from start to finish, ensuring recovery time between shifts.
