How overtime and hours work

The Hôtels, Cafés, Restaurants (HCR) agreement sets a contractual reference week of 39 hours, above France's 35-hour statutory reference. Weekly working time is capped at 48 hours, with a 46-hour average over any 12 consecutive weeks. Daily hours are limited to 10, within a maximum span of 13 hours, and staff must receive at least 11 consecutive hours of rest between shifts. Overtime uses a distinctive HCR scale rather than the general 25 percent rate: hours from 36 to 39 are paid at a 10 percent premium, 40 to 43 at 20 percent, and 44 and above at 50 percent. The annual overtime quota is 360 hours, and overtime may be offset by compensatory rest instead of pay.

Frequently asked

Is 48 hours the maximum working week under HCR?+

Yes. Weekly working time cannot exceed 48 hours in any single week, and the average must stay at or below 46 hours across any 12 consecutive weeks. The contractual reference week is 39 hours, so hours worked between 39 and 48 count as paid overtime.

What is the minimum rest between two shifts?+

Employees are entitled to at least 11 consecutive hours of daily rest between the end of one shift and the start of the next. Weekly rest is at least 35 consecutive hours. The working day may also span no more than 13 hours from start to finish.

How is overtime paid in HCR?+

HCR uses its own scale rather than the general 25 percent rate. Hours from 36 to 39 carry a 10 percent premium, 40 to 43 a 20 percent premium, and 44 and above a 50 percent premium. The annual quota is 360 hours, and premiums may be replaced by equivalent compensatory rest.
