Public holidays in Brazil, explained
Brazil's public holiday calendar is built in three layers, and understanding the split is essential for payroll accuracy. The first layer is the national (federal) tier defined by Law 662/1949 and Law 6.802/1980, covering fixed dates such as New Year, Tiradentes, Labour Day, Independence Day, Our Lady of Aparecida, All Souls' Day, Proclamation of the Republic and Christmas. These are mandatory across all 26 states and the Federal District, and employers cannot opt out of them.
The second layer is state holidays, set by each state to mark events like the date of its own political emancipation. The third layer is municipal: every município may establish up to 4 local holidays, and in practice these almost always include the city's founding anniversary and the feast day of its patron saint. Because of this, two employees in the same company but in different cities can have genuinely different holiday calendars, which is why a single national list is never enough for a distributed workforce.
Two widely observed dates sit outside the mandatory tiers. Carnival (the Monday and Tuesday before Ash Wednesday) and Corpus Christi are commonly treated as pontos facultativos, or optional facultative points, rather than statutory national holidays. Public bodies and many private employers grant them, but they are discretionary unless a state law, municipal law or collective agreement makes them binding.
For payroll, the CLT (Consolidação das Leis do Trabalho) is clear that recognised holidays are paid rest days. An employee required to work on a holiday must receive double pay for that day unless the employer grants a compensatory day off in the same week, a rule reinforced by Law 605/1949. Facultative points carry no such statutory premium, so their cost depends entirely on company policy or the applicable convenção coletiva. Teams should therefore configure holiday rules per location, flag facultative days separately from mandatory ones, and track double-pay or compensatory-rest entitlements to keep leave balances and gross-to-net calculations correct.
